Advocating For Owners During Complex & Unique Insurance Claims

A large townhouse estate discovered its custom Italian-made LED public lighting had been replaced without authorisation by an unknown third party. The substituted fittings were incompatible with the original luminaires, causing continuous tripping of upstream circuit protection devices and leaving residents with a clear downgrade in lighting quality.

We lodged a police report on behalf of the owners corporation and also notified the insurer of a theft claim. After a lengthy investigation, it was discovered that council workers, while upgrading lighting on council-managed roads, mistakenly believed that the estate’s lights were also part of council-managed roads and replaced those lights too. The insurer wasn’t confident whether lighting on OC-managed roads was ultimately council’s responsibility, and sought external legal advice to clarify the matter. Rather than accepting the insurer’s hesitation over liability, we followed up extensively and pushed the claim through to resolution. In the end, the owners corporation received the outcome it was entitled to and the claim was settled in favour of the owners corporation.

Proactive Repairs & Risk Management Contributed To Lower Fees For Owners

Owners resolved at their annual general meeting to commission an OH&S report, and the strata manager took ownership of the process from the start. We coordinated the report, worked closely with the committee to action every recommendation and organised targeted works across the estate. These works included replacing damaged drain grates, installing bollards in front of gas meters and repairing cracked concrete on pathways to eliminate tripping hazards.

The strata manager then updated the insurer and submitted the completed works ahead of policy renewal. The result: instead of the typical 10-15% premium increase, the owners corporation secured a 5.6% decrease, saving owners almost $1,500. The insurer recognised the committee’s proactive approach, and clearly demonstrated that staying ahead of maintenance obligations protects both residents and the financial health of the scheme.
